Elon Musk's $1 million daily voter giveaway in swing states isn't randomly selected, according to his lawyer Chris Gober's testimony in a Pennsylvania court. The recipients are strategically chosen based on their ability to represent Musk's pro-Trump super PAC, America PAC.

The Philadelphia District Attorney's Office filed a lawsuit against Musk and America PAC, alleging election fraud and illegal lottery operations. The lawsuit claims the scheme entices citizens to provide personal information and make political pledges for a chance at $1 million.

Key revelations from the court hearing:

  • Winners are pre-selected, not chosen by chance
  • Recipients must serve as PAC spokespersons
  • Selection is based on personal stories
  • Final prizes will go to Arizona and Michigan voters
  • 16 checks worth $1 million each have been distributed
  • Four Pennsylvania residents received payments

The Justice Department issued a warning to Musk and America PAC on October 23, citing potential legal violations. Federal law prohibits paying or offering payment for voter registration or voting, with penalties of up to five years in prison.

Despite attempts to move the case to federal court and the Philadelphia DA's lawsuit, Judge Angelo Foglietta declined to block the program. The controversy continues as the scheme operates in key swing states leading up to the election.
