The indictment details multiple instances of alleged physical and emotional abuse of their teenage daughter, including:

  • Mayor Small allegedly striking his daughter with a broom (January 13, 2024)
  • Throwing her down stairs (early January 2024)
  • Threatening to "smack the weave out" of her head
  • Mrs. Small allegedly punching her daughter in the chest, causing bruising

The couple's attorney, Ed Jacobs, maintains their innocence and expects full exoneration. The charges carry potential penalties of 5-10 years in prison and fines up to $150,000.

Key evidence includes videos captured on the daughter's boyfriend's iPad, including footage where the mayor can be heard saying, "Don't make me hurt you!"

Atlantic City High School Principal Constance Days-Chapman faces separate charges of official misconduct for allegedly failing to report the abuse when informed by the victim.

Small, who became mayor in 2019 following Frank Gilliam's resignation over embezzlement charges, has stated through his attorney that he won't resign from his position. This case adds to Atlantic City's troubled political history, where four mayors since 1970 have faced corruption charges.

The attorney maintains this is a private family matter unrelated to Small's duties as mayor, stating, "This indictment has absolutely nothing to do with Marty Small's tenure as mayor. There's no charge of corruption or any official misconduct."
